It may not need a probate at all. Whether you qualify is arithmetic, not argument.

California allows smaller estates to be collected by affidavit, without opening a proceeding, once forty days have passed since the death. There is a separate route for real property of small value.

The thresholds change, and they are worth checking before you agree to anything. Ask whoever tells you a probate is required to show you the arithmetic.

What this involves

  • Small estate affidavit for personal property
  • Petition for real property of small value
  • Working out whether the estate qualifies
  • What is counted and what is not
