Probate

Petition for probate

Request a free consultation for probate

The filing that appoints someone with authority to act, and everything that follows it.

Nothing can be moved until the court appoints a personal representative. The petition asks for that appointment, and the letters the court issues are what a bank or a title company will actually accept.

From there the proceeding is a sequence: notice, inventory and appraisal, creditor period, and a final petition for distribution. Most of what goes wrong is a step taken in the wrong order.

What this involves

  • Petition for probate and the hearing on it
  • Letters testamentary or of administration
  • Inventory and appraisal by a probate referee
  • Petition for final distribution
